These Terms of Service (“Terms”) apply to your access to and use of the websites, mobile sites and other online offerings (collectively, the “Site”) provided by House Majority PAC (the “Committee,” “we,” or “us”) that link to these Terms. By accessing or by using our Site, you agree to these Terms, and any terms incorporated by reference. If you do not agree to these Terms, do not use our Site.

We may make changes to these Terms from time to time. If we make changes, we will provide you with notice of such changes, such as by sending an email, providing a notice through our Site or updating the date at the top of these Terms. Unless we say otherwise in our notice, the amended Terms will be effective immediately, and your continued use of our Site after we provide such notice will confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using our Site.

  2. Consent to Use of Data and Mobile Communication; SMS Program Terms
    You consent to our communicating with you about the Site and the Committee by SMS, text message, email or other electronic means. Your carrier’s normal messaging, data and other rates and fees will apply to these communications.
    If you subscribe to any text programs that the Committee makes available, the following terms apply:
    By subscribing to Committee updates or alerts, you consent to receive recurring messages or alerts by automatic text message. Text STOP to stop. Neither the Committee nor the participating carriers guarantee that messages will be delivered. The Committee may discontinue the program at any time without notice.
  3. User Content
    Our Site may allow you and other users to create, post, store and share content, including messages, comments, stories, text, photos, graphics, videos, music, and other materials (collectively, “User Content”). You may also submit User Content to the Committee by other means, including email and text message. Except for the license you grant below, you retain all rights in and to your User Content, as between you and the Committee.
    By posting, submitting or otherwise providing any User Content to the Committee, you grant the Committee and its independent contractors, service providers, consultants and joint committee members, a perpetual, irrevocable, nonexclusive, royalty-free, worldwide, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your User Content and any name, username or likeness provided in connection with your User Content in all media formats and channels now known or later developed without compensation to you. When you post or otherwise share User Content with the Committee, whether through our Site or otherwise, you understand that your User Content and any associated information (such as your username or profile photo) may be visible to others and you release the Committee, and anyone acting under its authorization, from any claims that any use of your User Content as authorized herein violates any of your rights, including any rights of publicity or privacy.
    You may not create, post, store or share any User Content that violates these Terms or for which you do not have all the rights necessary to grant us the license described above. You represent and warrant that your User Content, and our use of such content as permitted by these Terms, will not violate any rights of or cause injury to any person or entity. Although we have no obligation to screen, edit or monitor User Content, we may delete or remove User Content at any time and for any reason with or without notice.
  4. Prohibited Conduct and Content
    You will not violate any applicable law, contract, intellectual property right or other third-party right or commit a tort in connection with any User Content you post to the Site or otherwise provide to the Committee, and you are solely responsible for your conduct while using our Site. You will not:
    ▪ Engage in any harassing, threatening, intimidating, predatory or stalking conduct;
    ▪ Use or attempt to use another user’s account without authorization from that user and the Committee;
    ▪ Impersonate or post on behalf of any person or entity or otherwise misrepresent your affiliation with a person or entity;
    ▪ Sell, resell or commercially use our Site;
    ▪ Copy, reproduce, distribute, publicly perform or publicly display all or portions of our Site, except as expressly permitted by us or our licensors;
    ▪ Modify our Site, remove any proprietary rights notices or markings, or otherwise make any derivative works based upon our Site;
    ▪ Use our Site other than for its intended purpose and in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying our Site or that could damage, disable, overburden or impair the functioning of our Site in any manner;
    ▪ Reverse engineer any aspect of our Site or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of our Site;
    ▪ Use any data mining, robots or similar data gathering or extraction methods designed to scrape or extract data from our Site;
    ▪ Develop or use any applications that interact with our Site without our prior written consent;
    ▪ Send, distribute or post spam, unsolicited or bulk commercial electronic communications, chain letters, or pyramid schemes;
    ▪ Bypass or ignore instructions contained in our robots.txt file; or
    ▪ Use our Site for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.
    You may also post, submit, or otherwise share only User Content that is nonconfidential and that you have all necessary rights to disclose. You may not create, post, submit, store or share any User Content that:
    ▪ Is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory or fraudulent;
    ▪ Would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party or otherwise create liability or violate any local, state, national or international law;
    ▪ May infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;
    ▪ Contains or depicts any statements, remarks or claims that do not reflect your honest views and experiences;
    ▪ Impersonates, or misrepresents your affiliation with any person or entity;
    ▪ Contains any unsolicited promotions, advertising or solicitations;
    ▪ Contains any private or personal information of a third party without such third party’s consent;
    ▪ Contains any viruses, corrupted data or other harmful, disruptive or destructive files or content; or
    ▪ In our sole judgment, is objectionable, restricts or inhibits any other person from using or enjoying our Site, or may expose the Committee or others to any harm or liability of any type.
    Enforcement of this Section 5 is solely at the Committee’s discretion, and failure to enforce this section in some instances does not constitute a waiver of our right to enforce it in other instances. In addition, this Section 5 does not create any private right of action on the part of any third party or any reasonable expectation that the Site will not contain any content that is prohibited by such rules.
  5. Ownership; Limited License
    The Site, including the text, graphics, images, photographs, videos, illustrations and other content contained therein, are owned by the Committee or our licensors and are protected under both United States and foreign laws. Except as explicitly stated in these Terms, all rights in and to the Site are reserved by us or our licensors. Subject to your compliance with these Terms, you are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use our Site for your own personal, noncommercial use. Any use of the Site other than as specifically authorized herein, without our prior written permission, is strictly prohibited, will terminate the license granted herein and violate our intellectual property rights.
  6. Trademarks
    House Majority PAC and our logos, our product or service names, our slogans and the look and feel of the Site are trademarks of the Committee and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and Committee names or logos mentioned on the Site are the property of their respective owners. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us.
  7. Feedback
    You may voluntarily post, submit or otherwise communicate to us any questions, comments, suggestions, ideas, original or creative materials or other information about the Committee or our Site (collectively, “Feedback”). You understand that we may use such Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you, including, without limitation, to develop, copy, publish, or improve the Feedback in Committee’s sole discretion. You understand that the Committee may treat Feedback as nonconfidential.
  8. Repeat Infringer Policy; Copyright Complaints
    In accordance with the Digital Millennium Copyright Act and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the intellectual property rights of others. If you believe that anything on our Site infringes any copyright that you own or control, you may notify the Committee’s designated agent as follows:

Please see 17 U.S.C. § 512(c)(3) for the requirements of a proper notification. Also, please note that if you knowingly misrepresent that any activity or material on our Site is infringing, you may be liable to the Committee for certain costs and damages.

  1. Third-Party Content, Products, and Sites.
    We may provide information about third-party organizations, events, products, services, or activities, or we may allow third parties to make their content and information available on or through the Site (collectively, “Third-Party Content”). We provide Third-Party Content as a service to those interested in such content. Your dealings or correspondence with third parties and your use of or interaction with any Third-Party Content are solely between you and the third party. The Committee does not control or endorse, and makes no representations or warranties regarding, any Third-Party Content, and your access to and use of such Third-Party Content is at your own risk.
  2. Indemnification
    To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless the Committee and its independent contractors, service providers, and consultants, successor organizations, and joint committee members, and each of their respective officers, directors, agents, partners and employees (individually and collectively, the “Indemnified Parties”) from and against any losses, liabilities, claims, demands, damages, expenses or costs (“Claims”) arising out of or related to (a) your User Content or Feedback; (b) your violation of these Terms; (c) your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); or (d) your misconduct in connection with the Site. You agree to promptly notify Indemnified Parties of any third-party Claims, cooperate with Indemnified Parties in defending such Claims and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys’ fees). You also agree that the Indemnified Parties will have control of the defense or settlement, at the Indemnified Party’s sole option, of any third-party Claims.
  3. Disclaimers
    Your use of our Site is at your sole risk. Except as otherwise provided in a writing by us, our Site and any content therein are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, the Committee does not represent or warrant that our Site is accurate, complete, reliable, current or error-free. While the Committee attempts to make your use of our Site safe, we cannot and do not represent or warrant that our Site or servers are free of viruses or other harmful components. You assume the entire risk as to the quality and performance of the Site.
  4. Limitation of Liability
    To the fullest extent permitted by applicable law, the Committee and its contractors, service providers, consultants, successor organizations, and joint committee members, and each of their respective officers, directors, agents, and employees (collectively the “Committee-Related Parties”), will not be liable to you under any theory of liability—whether based in contract, tort, negligence, strict liability, warranty, or otherwise—for any indirect, consequential, exemplary, incidental, punitive or special damages or lost profits, even if such parties have been advised of the possibility of such damages.
    The total liability of the Committee and Committee-Related Parties for any claim arising out of or relating to these Terms or our Site, regardless of the form of the action, is limited to the greater of $5
  5. Governing Law and Venue
    Any dispute arising from these Terms and your use of the Site will be governed by, construed, and enforced in accordance with the laws of the District of Columbia, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles (whether of District of Columbia or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. Any dispute between the parties will be resolved in the federal courts of the District of Columbia.
  6. Modifying and Terminating our Site
    We reserve the right to modify our Site or to suspend or stop providing all or portions of our Site at any time. You also have the right to stop using our Site at any time. We are not responsible for any loss or harm related to your inability to access or use our Site.
  7. Severability
    If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
  8. Miscellaneous
    The failure of the Committee to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity. You agree that the communications and transactions between us may be conducted electronically.

This website is operated by the House Majority PAC (“HMP”, “we” or “us”). This privacy policy (“Policy”) explains how personal information is collected, used, and disclosed by HMP with respect to your use of thehousemajoritypac.com Web site and other House Majority PAC Web and mobile sites and applications which display this Policy (the “Sites”) so you can make an informed decision about using the Sites. This Policy also applies to personal information collected on other web sites and mobile sites on our behalf by third party vendors. We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the Policy the date it was last updated. We encourage you to review this Policy from time to time to make sure that you understand how any personal information you provide will be used.

What Is Personal Information?
As used herein, the term “personal information” means information that specifically identifies an individual (such as a name, address, telephone number, mobile number, e-mail address, or credit card number) and information about that individual or his or her activities that is directly linked to personally identifiable information. Personal information does not include “aggregate” information, which is data we collect about the use of the Sites or about a group or category of services or users, from which individual identities or other personal information has been removed. This Policy in no way restricts or limits our collection and use of aggregate information.

What Personal Information Do We Collect?
Active Collection: Personal information may be collected in a number of ways when you visit our Sites. We collect certain information you voluntarily provide to us, such as when you create an account or a profile, make a donation, make a purchase, send us an email or sign up to receive email or text message updates, fill out a form, connect through a social feed, sign up to be a volunteer or host an event, request information, apply for an internship, or use a Voter Registration Form tool. Such information may include personal information, such as your name, mailing address, email address, phone number, and credit card information. Personal and demographic information may also be collected if you provide such information in connection with creating a profile or group, leaving comments, posting videos, stories, comments or other content, sending an email or message to another user, or participating in any interactive forums or features on the Sites. In addition, from time to time we may collect demographic, contact or other personal information you provide in connection with your participation in surveys, contests, games, promotions, and other activities on the Sites.

In addition, the Federal Election Commission (FEC) may require us to collect personal information from donors. For example, the FEC requires us to collect (and disclose) the name, mailing address, occupation, and employer of all individuals whose donations exceed $200 per calendar year.

If we add a Voter Registration tool and you use it, you may also provide your driver’s license number, your social security number or the last four digits of your social security number, but that information would be deleted after the form is printed, so we would not retain it.

Passive Collection: When you use the Sites, some information is also automatically collected, such as your Internet Protocol (IP) address, your operating system, the browser type, the address of a referring web site, and your activity on our Sites. We treat this information as personal information if we combine it with or link it to any of the identifying information mentioned above. Otherwise, it is used in the aggregate only.

We may also automatically collect certain information through the use of “cookies” or web beacons. Cookies are small data files stored on your hard drive at the request of a website. Among other things, cookies help us improve our Sites and your experience. Information obtained from cookies and linked to personally identifying information is treated as personal information. If you wish to block, erase, or be warned of cookies, please refer to your browser manufacturer to learn about these functions. When you view a video on our Sites, a third party may also set a “flash cookie” on your computer. Removing and rejecting browser cookies does not necessarily affect third party flash cookies used in connection with our Sites. Web beacons are small, invisible graphic images that may be used on the Sites or in emails relating to the Sites to collect certain information about usage and campaign effectiveness and monitor user activity on the Sites.

Collection By Third Parties: Third party vendors may use cookies or other technologies to serve ads on this or other websites based on your visits to this site and other sites on the Internet and to provide analytics services. These third parties may automatically collect information about your visits to this and other websites, your IP address, your ISP, the browser you use to visit our Site, pages viewed, time spent on pages, links clicked and conversion information. They do this by using cookies, clear gifs or other technologies. Information collected may be used by HMP and third parties, among other things, to analyze and track data, to solicit donations, to deliver advertising or content on this or other websites based on your prior activities on this or other sites or targeted to your interests and to better understand the usage and visitation of our Sites and the other sites tracked by these third parties. This Policy does not apply to, and we are not responsible for, cookies or clear gifs used by the third parties, and we encourage you to check the privacy policies of advertisers and/or ad services to learn about their use of cookies and other technology. In some cases, third party vendors may collect personal information from you, such as your name and email address, on other web sites and provide this information to us, or HMP may collect personal information that you enter directly within an advertising unit. This Policy does apply to such personal information collected online in this manner, and we will treat such information in the same manner as information collected on our Sites.

How Do We Use the Personal Information We Collect?
We use personal information collected through our Sites for the purposes described in this Policy or elsewhere on the Sites. For example, we may use personal information we collect:

to provide the services, products, or information you request, and to process and complete such requests and any related transactions;
to send you confirmations, updates, alerts, and support and administrative messages and otherwise facilitate your use of, and our administration and operation of, the Sites;

for any other purpose for which the information was collected.
What Personal Information Do We Share With Third Parties?
It is our policy not to share the personal information we collect from you through our Sites with third parties, except as described in this Policy or as otherwise disclosed on the Sites. For example, we may share personal information as follows:

with vendors, consultants, and other service providers or volunteers who are engaged by or working with us and who need access to such information to carry out their work for us;
with candidates, organizations, groups or causes that we believe have similar political viewpoints, principles or objectives;
to report required information to the Federal Elections Commission, including name, mailing address, occupation, and name of employers of individuals whose contributions exceed $200 in a calendar year (for additional information, visit the FEC website at http://www.fec.gov);
when you give us your consent to do so, including if we notify you on the Sites, that the information you provide will be shared in a particular manner and you provide such information;
when we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests, claims or legal authorities, including responding to lawful subpoenas, warrants, or court orders;
when we believe in good faith that doing so is reasonably necessary or appropriate to respond to claims or to protect the rights, property, or safety of HMP, our users, our employees, our volunteers, copyright owners, third parties or the public, including without limitation to protect such parties from fraudulent, abusive, inappropriate, or unlawful activity or use of our Site;
to enforce or apply this Policy, our Terms of Service, or our other policies or agreements; and
in connection with, or during negotiations of, any reorganization, formation of new committee, asset sale or transfer, financing or lending transaction or in any other situation where personal information may be disclosed or transferred as one of the assets of HMP.
The above excludes text messaging originator opt-in data and consent, which information will not be shared with any third parties, provided that the foregoing does not apply to sharing (1) with vendors, consultants and other service providers who need access to such information to carry out work on our behalf (and who will not use such information for their own purposes); (2) if we believe disclosure is required by any applicable law, rule, or regulation or to comply with law enforcement or legal process; and (3) if the user consents to our sharing of such information.
We are not responsible for the actions of any service providers or other third parties, nor are we responsible for any additional information you provide directly to any third parties, and we encourage you to become familiar with their privacy practices before disclosing information directly to any such parties. Nothing herein restricts the sharing of aggregated or anonymized information, which may be shared with third parties without your consent.

Online Petitions:
If you sign an online petition, you understand that such petition is public information and that we may make the petition, and your name, city, state, and any comments provided in connection therewith publicly available. In addition, we may provide such petitions or compilations thereof, including your comments, name, city, and state to national, state or local leaders, or to the press.

Interactive Features:
You understand that when you use the Sites, information you post in your profile, blogs, forums and other interactive areas of the Sites, as well as any information you share with individuals through the Sites or share through social network sites, will be available to other users and, in some cases, may be publicly available. In addition, when you sign up and create an account, certain information regarding actions you take through the Sites, such as joining a group or actions tracked under the “Making a Difference” section of your profile, may available to other users and, in some cases, may be publicly available. We recommend you be cautious about giving out personal information to others or sharing personal information in public or private online forums. We are not responsible for the actions of any third parties with whom you share personal information.

Social Plugins:
The Sites may use social plugins (“Plugins”), which lets friends share actions they take across web sites (e.g. the Facebook “Like” button). Plugins are generally identifiable by the logo for the applicable social network or other notice indicating the use of a Plugin. When you visit a page of our website that contains a Plugin, your browser establishes a direct connection to the servers of the social network providing the Plugin, which enables that social network to receive certain information, such as information about your having accessed the respective page of our Site. If you are logged into the applicable social network, your visit can be assigned to the account of such social network. If you interact with the Plugins, for example by clicking “Like,” or entering a comment, the corresponding information is transmitted from your browser directly to the social network providing the Plugin and is stored by it. Even if you are not logged into that social network, there is possibility that the Plugins transmit certain information, such as your IP-address, to the applicable social networks. For information on the purpose and scope of data collection and processing by such social networks, as well as your rights in this respect and settings options for protecting your privacy please visit the privacy policy page for the social network providing the Plugin. If you do not want the social networks providing the Plugins to connect the data concerning your visit to our website with your member data already stored by such social networks, you must log off all such social networks before entering our website. Simply closing the social network page does not suffice.

Our Sites may contain links to other websites. Any personal information you provide on the linked pages is provided directly to that third party and is subject to that third party’s privacy policy. This Policy does not apply to such linked sites, and we are not responsible for the content or privacy and security practices and policies of these websites or any other sites that are linked to from our Sites. We encourage you to learn about their privacy and security practices and policies before providing them with personal information.

What Steps Do We Take To Protect Your Information Online?
We take reasonable measures to protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission that can be guaranteed against any interception or other type of misuse. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of our web sites by any person using your password. Please advise us immediately if you believe your password has been misused.

What Choices Do You Have Regarding the Use of Your Information?
You may “opt out” of receiving text messages, email updates and newsletters by following the instructions in those text messages and emails. Please note that we may still send you other types of emails, such as emails about your use of our Sites, or use information as otherwise described in this Policy, even if you opt out of receiving email updates and newsletters. You can view or modify information stored with your user account by clicking ‘update your information’ in the footer of any email we send.
